Wrongful death lawsuits

It’s heartbreaking when you lose someone you love, and even worse when that person didn’t need to die.

In the case of a wrongful death, you need to be able to prove that a third party was negligent, whether it’s a healthcare provider, company or person, who did not provide your loved one with the care that would be reasonably expected to prevent harm. This is called duty of care.

For a wrongful death case, you need the following:

  • enough evidence for the judge to agree that the defendant should have extended duty of care to your loved one, the victim
  • a similar case for the court to compare to your loved one’s situation
  • proximate cause: corroboration that shows your loved one would have lived if not for the negligence of the defendant
  • the ability to prove to the court that there were losses that impacted you and your family, such as hospital bills, loss of income, funeral and burial costs, and companionship
